A Review Committee shall be established at the institution in accordance with the provisions of the Act.
The Review Committee shall be composed of three (3) members appointed by the Board of Directors of the institution. The Chairman of the Committee shall be appointed from among elected or co-opted members of the Board of Directors. The other two (2) members shall be appointed from among physicians, dentists, and pharmacists who practice their profession in a centre operated by one of the institutions in the region of the local Health and Social Services network, the activities and services of which are coordinated by the institution. The appointments shall be made on the recommendation of the Council of Physicians, Dentists and Pharmacists of the institution and of the other institutions in the region, or, when no such council has been established at an institution, after consulting with the physicians, dentists, and pharmacists concerned.
Except where a complaint is referred for disciplinary investigation, the function of the Review Committee, when requested by the complainant or the professional against whom the complaint is directed, is to review how a complaint made by a user or any other person is handled by the medical examiner of an institution in the region of the local Health and Social Services network.
The Review Committee must submit an Annual Report to the Board of Directors, sending a copy to the Council of Physicians, Dentists and Pharmacists of each institution in the region of the local Health and Social Services network no later than March 31st of each year and whenever deemed necessary. The report must describe the reasons for the complaints which gave rise to an application for review since the last report, its conclusions, and the amount of time it took to process the review files. It may also make recommendations, particularly for the improvement of the quality of medical, dental, and pharmaceutical care or services provided in a centre operated by an institution in the region of the local Health and Social Services network.
A copy of this report must also be submitted to the local Service Quality and Complaints Commissioner of each institution in the region so that its contents may be incorporated in the report submitted under section 76.10 of the Act, as well as to the Health Services Ombudsman.
